"Power of Attorney Terms"

Art. 1 General Provisions

1. The Power of Attorney Terms apply when a sales agreement is concluded via the www.winnicaksiezycowa.pl store and executed through an Attorney-in-Fact. In all other matters, the Website Terms & Conditions apply.

2. Definitions used in the Website Terms & Conditions also apply to these Power of Attorney Terms. Additional definitions include:

1) Website Terms & Conditions – The terms and conditions available on theWebsite Terms & Conditionspage; 

2) Power of Attorney Terms – This document.

3) Attorney-in-Fact – A person authorized by the Client to collect Goods from the Store on their behalf and deliver them to the address specified by the Client, and/or to make payment for the Goods, under the conditions set forth in these Power of Attorney Terms. The Attorney-in-Fact does not enter into a sales agreement in their own name but acts on behalf of and for the benefit of the Client within the scope specified in the power of attorney.

Art. 2 Power of Attorney

1. By using the services of the Attorney-in-Fact, the Client authorizes them to collect the Goods from the Store on their behalf and deliver them to the address specified by the Client, and/or to make payment for the Goods on their behalf.

2. Utilizing the services of the Attorney-in-Fact requires:

1) Placing an Order via the Website and selecting delivery through an Attorney-in-Fact.

2) During the ordering process, making the required declarations regarding the Website Terms & Conditions, Power of Attorney Terms, and other related provisions.

3) Providing the necessary information required to fulfill the Order.

3. The Client grants the power of attorney to the Attorney-in-Fact selected during the ordering process when choosing the delivery option. The Attorney-in-Fact may also be the Operator. In such a case, the Client expressly consents to the other party of the Sales Agreement (i.e., the Operator) acting as the Attorney-in-Fact.

4. The Client pays the Attorney-in-Fact’s fee, including delivery costs, along with the payment for the Order.

5. For prepayment orders, the Client authorizes the Attorney-in-Fact to receive their fee, including delivery costs, from the Operator.

Art. 3 Additional Provisions

1. To confirm the Client's legal age, the Attorney-in-Fact is authorized to request an electronic scan or verification of an identity document.

2. The Attorney-in-Fact will not deliver the Order to a person who appears to be intoxicated. 

3. The Client has the right to withdraw from using the services of the Attorney-in-Fact without providing a reason until the Order is collected by the Attorney-in-Fact.

4. The Operator informs the Client that if the service is provided before the withdrawal period expires, in accordance with the Consumer Rights Act, the right to withdraw may be lost.

5. The right to withdraw from using the Attorney-in-Fact's services is exercised by submitting a withdrawal statement. The statement must be sent to winnica@winnicaksiezycowa.pl or in another clear manner ensuring it reaches the Operator.

6. If the Client withdraws from using the Attorney-in-Fact’s services, the Order may only be collected from the Store, and the Client may choose a different Attorney-in-Fact.

7. If the Client withdraws from using the Attorney-in-Fact’s services before the Order is collected, they will receive a refund of the Attorney-in-Fact’s fee. The refund will be processed using the same payment method used in the original transaction unless the Client explicitly requests otherwise.

8. For payments made via bank transfer or online payment, the Operator will release the Order to the Attorney-in-Fact only after the payment has been received. The Attorney-in-Fact will then deliver the Order to the address specified in the Order. 

Art. 4 Final Provisions

1. In all matters not regulated by these Power of Attorney Terms, the Website Terms & Conditions or applicable general legal provisions shall apply.

2. If any provision of these Power of Attorney Terms is found to be invalid, this shall not affect the validity of the remaining provisions.

Appendix 1 – Power of Attorney Template

I declare that, as a Client of the Website, I grant power of attorney to the Attorney-in-Fact to collect my order. This power of attorney is valid from the date of order placement until the order is fulfilled.
